to the extent

to the extent, 在法律條文中常常看到這個片語，
單就文義上來看並不這麼複雜，但這個片語放在法律文本當中，
突然就變得撲朔迷離起來。


讓我們先從extent這個字說起。
extent n. range or scale of something
也就是有範圍、程度的意思
因此比較常看到的用法有：to a certain extent 某種程度上
to a great extent 很大程度上
再來個常見的例句：
To some extent ,I agree with you.



那麼回到我們討論的to the extent上來，
可以翻譯成：達到...的程度，在某種程度以內
因此有人便說to the extent=insofar as
ok~到目前為止相信也都還很好理解。

法律文本中運用這個片語，
則常以 to the extent that+clause的用法
這下子，究竟要怎麼理解？ 怎麼翻譯成中文？

先看一個非法律文本的例子。

I'm really not interested in politics. To the extent that I think about politics at all, I tend to support the Democrats.

In other words, I almost never think about politics, but on the rare occasion that I do, I agree with the Democrtats. My interest is low, and my support for the Democrats is proportionally mild.

因此，斜體字的部份若直譯成"在極少數我考慮政治的程度以內"實在是拗口又難以理解，
若改翻譯成"於極少數我考慮政治的情形之下"、或是"倘若極少數我考慮政治時"
應該是比較合理的翻譯。

承襲這樣的脈絡，法律條文中的例子也就不難體會了。

To the extent that Party B has any rights, claims, and interests in Bank's obligations under the Agreement,....

根據本契約規定之銀行義務，乙方享有權利、主張及利益的情形...
根據本契約規定之銀行義務，若乙方享有權利、主張及利益...


結論是：To the extent that Clause
可翻成「於......的情形之下」或「倘若......」。

不過這又有個小問題，
老實說後者的翻法語意最順，
但是to the extent用假設句的翻法是否為妥還是可以斟酌一下地，
不過這是後話了。
